Crypto Perpetual Futures: What the CFTC's Cross-Border Guidance Means

A 2026 US derivatives interpretation illustrates how exchange structure and customer collateral can matter as much as token prices.

In a May 29, 2026 release, the US Commodity Futures Trading Commission said its market-participants staff had issued an interpretation involving certain digital-asset perpetual contracts on a foreign trading venue. The statement also described a narrowly conditioned no-action position related to a registered futures intermediary and the use of customer collateral.

These developments do not mean every offshore perpetual contract automatically carries the same protections as a US-listed future. The venue, intermediary, governing rules, margin arrangements and regulatory jurisdiction still matter. A no-action letter is also different from a universal regulatory exemption or blanket approval of an industry practice.

For market participants, the practical questions include who holds collateral, what happens if a broker fails and whether positions settle in cash or tokens. The CFTC separately warns that leverage can magnify losses and force liquidation. This explainer is based on published regulatory guidance rather than any claim about a particular day's token price.
