Microsoft's Green-Card Suspension: What H-1B Workers Need to Know in 2026

Microsoft president Brad Smith says restrictions on skilled-worker green cards could hurt US technology. We explain the PERM process, affected workers and limits of the announcement.

Microsoft president Brad Smith has publicly challenged US restrictions on the company's ability to sponsor certain foreign workers for permanent residency. In comments reported by Reuters on October 15, 2026, Smith warned that narrowing pathways to green cards could push skilled technology workers toward other countries and weaken US competitiveness.

This matters especially to people working in the United States on H-1B status and considering employment-based permanent residence. The key is to understand which immigration process has been affected and which conclusions cannot be drawn from the political dispute alone.

What did the administration announce?

The administration said it would suspend Microsoft and seven other companies from a permanent labor certification pathway, amid government allegations of abuse in employment-based immigration. Officials argue that protecting jobs and ensuring employers follow labor standards should be central to the program. Companies and their supporters dispute aspects of the allegations and the economic consequences of the action.

The reported restrictions concern an employer's ability to use the PERM labor-certification process. PERM is a Department of Labor step used in many employer-sponsored employment-based green-card applications. It involves testing whether qualified and willing US workers are available for the offered position and whether employing the foreign worker would adversely affect domestic wages and conditions.

This is not the same administrative process as a temporary H-1B petition, and the announcement does not by itself say every existing foreign worker must leave the country.

What did Brad Smith say?

Smith told Politico, in comments summarized by Reuters, that blocking routes to permanent residency could severely damage the American technology industry over time. He also rejected Vice President JD Vance's allegations that Microsoft had misused the H-1B system. According to Reuters, Smith said foreign-born and US employees use the same company compensation system.

Smith pointed to Microsoft's hiring of more than 9,000 US-born workers in the previous year to dispute the suggestion that the company's employment strategy was simply to replace domestic workers with lower-paid immigrants.

His remarks are Microsoft's position in a contested policy debate, not a legal ruling on whether the company met all labor-certification requirements. Government allegations and the company's response should be reported separately.

Does the suspension cancel an existing H-1B visa?

No blanket cancellation of existing H-1B visas was established by this reported PERM suspension. H-1B status, employment authorization, an employer's pending permanent-residency process and an eventual immigrant visa are related but separate legal questions.

Individuals can still be affected indirectly. A person approaching the ordinary six-year H-1B limit may be relying on a particular stage of the green-card process to qualify for extended status. The effect depends on filing dates, approvals, employment changes and individual circumstances.

This is an area where personal legal advice from a qualified US immigration attorney matters; general news cannot determine the status of a particular visa.

What about people with a pending PERM application?

A pending PERM case should not be described as approved or denied based solely on a headline. The agency's exact implementation rules, notice to the sponsoring employer and case stage determine what happens. Workers should confirm the status and any deadlines with the company's immigration counsel.

People with an approved I-140 petition, a pending I-485 adjustment application or other immigration history may have different options and risks. Neither the Reuters report nor a social-media claim can substitute for reviewing the worker's official records and the applicable rules.

Can a skilled worker switch companies?

Some H-1B workers may be able to transfer employers under existing immigration provisions, but a change can alter permanent-residency sponsorship and timing. The old employer's PERM process does not automatically move to a new company. Portability rules and priority-date retention depend on the filing stage and specific eligibility criteria.

A worker should obtain copies of notices, I-94 information, approved petitions and other pertinent documents, and discuss any planned move with counsel before resigning.

Why does this matter for US AI competitiveness?

AI development relies on a global pool of researchers, chip designers, engineers and technical specialists. Restrictive immigration policy may make attracting and retaining that talent harder, according to Smith and other industry voices. Supporters of stricter enforcement counter that skilled-immigration programs must protect US workers from unfair wage competition and employers must meet their obligations.

These goals are not logically identical. A country can seek rigorous enforcement while also debating how many skilled immigrants to admit. The current dispute turns partly on alleged employer conduct and partly on the larger policy balance between labor-market protections and access to talent.

Checklist for affected employees

Check the sponsoring employer named on the case, the exact stage of the process, all government filing receipts, visa and status expiration dates, and whether the company has supplied a formal notice about the suspension. Do not treat an online list of affected employers as a personalized immigration determination.

Ask the employer's immigration team what filings are paused, whether an existing I-140 is affected and whether special deadlines require action. Preserve documents and seek independent counsel if your status is time-sensitive.

The central fact on October 16 is that the political and legal dispute over permanent labor certification is ongoing. Existing workers should verify their personal cases before assuming an H-1B cancellation, automatic green-card denial or immediate departure requirement.
