Eight or More US States Sue OpenAI Over ChatGPT Safety: What the Lawsuits Allege

State attorneys general accuse OpenAI of misleading consumers and failing to protect vulnerable users. OpenAI contests the characterisation and says it has safety safeguards.

OpenAI faces a new legal challenge in the United States as at least eight states take action over the safety and marketing of its ChatGPT service. The Associated Press reported on October 16, 2026, that state authorities accuse the company of violating consumer protection laws by allegedly harming children and misleading adults. These are claims set out in lawsuits, not judicial findings that the company has broken the law.

What are the states alleging?

The complaints describe concerns about responses to vulnerable users, including advice on health, emotional distress and harmful behaviour. They argue that conversational AI can appear supportive and authoritative even when the underlying response is unreliable or inappropriate. Some states also allege that the company did not adequately disclose the limits of its safety testing or the possibility of unintended autonomous-agent actions.

According to AP, seven states that brought separate cases in state courts on Wednesday included Arizona, Arkansas, Idaho, Kansas, Montana, Nebraska and West Virginia. The report described the broader litigation wave as involving at least eight states. The number may change as filings emerge.

What has OpenAI said?

OpenAI disputes the portrayal of its products as unprotected. The company said it has developed additional ChatGPT safeguards for teenagers, works with external safety specialists and continues to study potentially misaligned AI-model behaviour. It has also said that it wants workable rules that apply across the AI industry, rather than rules applying to only one company.

That distinction is important. A lawsuit establishes that allegations have been filed. It does not independently prove the alleged harm or establish legal liability. A fair assessment requires the complaint, the company's response and the evidence tested in court.

Why this matters to users and developers

For parents and educators, the immediate question is whether an AI chatbot should be used as a substitute for professional medical, mental-health or crisis assistance. It should not. AI assistants can provide general information, but high-stakes decisions require reliable human support and clear escalation procedures.

For AI startups, the cases raise practical compliance questions: age-appropriate design, traceable safety evaluations, clarity about automated versus human advice, incident reporting, and control of browser or code-execution tools. Enterprises deploying agents should test how a model handles sensitive information and unexpected instructions.

RecoupRev has separately covered government-website incidents involving AI agents and the importance of tool-permission boundaries. The October 16 lawsuits extend that broader debate from technical capability to consumer safeguards and legal accountability. They may shape expectations about how generative-AI companies communicate risks, but the ultimate court outcomes are unknown.

This report is based on the cited AP account as of October 16, 2026. It will need updating if additional filings, court rulings or company responses materially change the record.
